Big Tobacco uses trade pacts to thwart new laws

As countries around the world ramp up their campaigns against smoking with tough restrictions on tobacco advertising, the industry is fighting back by?invoking international trade agreements to thwart the most stringent rules.

A key battlefront is Australia, which is trying to repel a legal assault on its groundbreaking law requiring cigarettes to be sold in plain packs without distinctive brand logos or colors. Contesting the law, which takes effect Dec. 1, are the top multinational cigarette makers and three countries ? Ukraine, Honduras and Dominican Republic ? whose legal fees are being paid by the industry.

The dispute underlines broader concerns about trade provisions that enable foreign companies to challenge national health, labor and environmental standards. Once a country ratifies a trade agreement, its terms supersede domestic laws. If a country?s regulations are found to impose unreasonable restrictions on trade, it must amend the rules or compensate the nation or foreign corporation that brought the complaint.


In the case of Australia?s plain packaging law, the tobacco industry and its allies are challenging the measure as a violation of intellectual property rights under trade agreements the nation signed years ago.

Public health advocates fear the legal attack will deter other countries from passing strong measures to combat the public health burdens of smoking. The ?cost of defending this case, and the risk of being held liable, would intimidate all but the most wealthy, sophisticated countries into inaction,? said Matthew L. Myers, president of the Campaign for Tobacco-Free Kids in Washington D.C.

The advocates also say countries should be free to decide how best to protect public health, without being second-guessed by unelected trade panels. Moreover, they argue, tobacco products, which kill when used as intended, should not be afforded the same trade protections as other goods and services.

Worldwide, nearly 6 million people a year die of smoking-related causes, according to the World Health Organization, which says the toll could top 8 million by 2030. With fewer people lighting up in wealthy nations, nearly 80 percent of the world?s 1 billion smokers live in low- and middle-income countries.

Countries have been emboldened to pass more stringent measures by the Framework Convention on Tobacco Control. In effect since 2005, the treaty has committed about 175 nations to pursue such measures as higher cigarette taxes, public smoking bans, prohibitions on tobacco advertising, and graphic warning labels with grisly images such as diseased lungs and rotting teeth (The U.S. has signed the treaty, but the Senate has not ratified it. The U.S. Food and Drug Administration has ordered graphic warnings for cigarette packs, but an industry court challenge on 1st Amendment grounds has stalled the rule.)

Cigarette makers say they acknowledge the hazards and the need for regulations. ?We actually support the vast majority of them,? said Peter Nixon, vice president of communications for Philip Morris International, which has its headquarters in New York, its operations center in Switzerland, and is the biggest multinational cigarette maker with 16 percent of global sales.

Bans on cigarette ads spread
But the industry has watched with growing concern as more than 35 countries have adopted total or near-total bans on cigarette advertising. Its big profits depend on consumer recognition of its brands. Yet in many countries, the once-ubiquitous logos and imagery are receding, leaving the cigarette pack as a last refuge against invisibility.

Now the pack, too, is under attack. Along with plain packaging laws such as Australia?s, countries are weighing retail display bans that keep cigarette packs out of view of consumers, and laws requiring graphic health warnings so large that there is barely any room for trademarks. Tobacco companies contend that countries enforcing such rules are effectively confiscating their intellectual property and must pay damages.

The industry also claims that measures like plain packaging are counterproductive. ?We see no evidence ? none at all ? that this will be effective in reducing smoking,? Nixon of Philip Morris International said in an interview. In fact, he said, generic packaging likely will increase sales of cheap, untaxed counterfeit smokes, thus increasing consumption.

The company would use ?all necessary resources and?where necessary litigation, to actively challenge unreasonable regulatory proposals,?? Camilleri said, specifically mentioning plain packaging and display bans.

Up to now, tobacco-related trade disputes have mostly involved quotas or tariffs meant to protect domestic producers from foreign competition.??

The key issue now, though, isn?t traditional trade barriers, but whether health regulations unduly restrict the movement of goods. In challenging anti-smoking rules, the industry has drawn on global treaties, such as the 1994 pact known as TRIPS (the Agreement on Trade Related Aspects of International Property Rights), that include broad protections for intellectual property and foreign investment.

In the hands of aggressive corporations, such long-standing provisions have become ??the ticking time bomb for this century as governments tackle problems like tobacco, the environment, obesity, access to essential medicines,? said Myers of the Campaign for Tobacco Free Kids.

Two recent legal decisions showed that such cases are no slam dunk for the industry.? In September, a court in Oslo, Norway, rejected a lawsuit by Philip Morris Norway AS that challenged the country?s retail display ban. The company had claimed that in enforcing the ban, Norway had violated the European Economic Agreement by failing to adopt the least trade-restrictive measures to achieve its public health goals.

The court, siding with Norway?s government, found that other measures would not be as effective in insuring that ?as few as possible youngsters begin to smoke.??

Australia also triumphed in the first round of its legal defense of plain packaging. Rejecting a lawsuit by the four top global companies -- Japan Tobacco Inc. and Imperial Tobacco, along with British American and Philip Morris International ? Australia?s High Court upheld the law as legal and constitutional.?

The law requires that all cigarettes be sold in drab olive-brown packs, with pictorial warnings covering 75 percent of the front and 90 percent of the back.

The goal is to reduce ?the attractiveness and appeal of tobacco products to consumers, particularly young people,? a spokeswoman for Australia?s Department of Health and Ageing said in an email to FairWarning.

But two major challenges remain.

Australia law challenged under trade pacts
In one, Philip Morris Asia has accused Australia of violating a 1993 bilateral trade pact between Hong Kong and Australia. Such agreements, known as investor-state treaties, allow a foreign investor by itself to bring an arbitration claim for damages against a country.

The case is before an arbitration panel of the U.N. Commission on International Trade Law.

In the other, Ukraine, Honduras and the Dominican Republic earlier this year brought their challenges before the World Trade Organization.

The complaint in March by Ukraine was a striking paradox. Its trade ministry filed the challenge within hours of Ukraine?s president signing a ban on tobacco advertising, and its parliament voting to ban public smoking ? revolutionary moves in chain-smoking Eastern Europe. Trade officials took the action despite Ukraine having no tobacco exports to Australia, and therefore no apparent financial interest in its anti-smoking policies.

But prodded by the tobacco industry, the trade ministry branded the plain packaging law as a violation of intellectual property rights that Australia was bound to protect.

Honduras and the Dominican Republic soon joined the attack on Australia, filing similar complaints with the WTO.

Cigarette makers are paying for heavyweight lawyers to represent the three countries.?

As company representatives have told FairWarning, Philip Morris International is paying the firm of Sidley Austin to represent the Dominican Republic, while British American is picking up legal expenses for Ukraine and Honduras.?

?We are happy to support countries who, like us, feel plain packaging could adversely affect trade,? said British American spokesman Jem Maidment.?

It?s not unusual in trade disputes for corporations to give legal assistance to governments with mutual interests. In this case, however, the three countries appear to have little, if any, direct stake in Australia?s tobacco control policies.

While tobacco exports from Ukraine to Australia are nonexistent, exports from Honduras and Dominican Republic in the past three years have averaged $60,000 (U.S.) and $806,000, respectively, according to figures from Australia?s Department of Foreign Affairs and Trade.

Responding in April to an inquiry from Ukrainian journalists, the country?s Ministry of Economic Development and Trade said it had ?a policy of supporting Ukrainian producers and protecting their interests in the internal and external markets.? In this case, the ministry said, it had ?received concerns? about Australia?s law from the Ukrainian Association of Tobacco Producers, made up of the top tobacco multinationals, and from the Union of Wholesalers and Producers of Alcohol and Tobacco Association.?

Konstantin Krasovksy, a tobacco control official in Ukraine?s Ministry of Health, told FairWarning the countries had allowed themselves to be used. ?Honduras, Dominican Republic and Ukraine agreed to be a prostitute,? he said.

Honduran officials, in an April press release, said Australia?s law ??contravenes?? its trade obligations. It noted that the tobacco industry ?employs several hundred thousand people directly and indirectly throughout the supply chain in Honduras.?

The Dominican Republic, a major cigar exporter, also said plain packaging ?will have a significant impact on our economy.?? In a written statement to FairWarning, Katrina Naut, director general for foreign trade with the country?s Ministry of Industry and Commerce, said that if other countries join Australia in adopting plain packaging, it will lead to falling prices for name-brand tobacco products and ?an increase ? rather than a decrease ? in consumption and illicit trade.??

Uruquay vs. Philip Morris
Among supporters of Australia, none is more vociferous than the government of Uruguay. It recently told the WTO?s Dispute Settlement Body that the global trading system ?should not force its Members to allow that a product that kills its citizens in unacceptable and alarming proportions continues to be sold wrapped as candy to attract new victims.?

Uruguay?s stance reflects its own high-stakes battle with Philip Morris.

The tobacco giant has challenged Uruguay?s requirement of graphic warnings on 80 percent of cigarette packs. Philip Morris is also fighting a rule that limits cigarette marketers to a single style per brand, making it illegal to sell Marlboro Gold and Green along with Marlboro Red.

The challenge by Swiss units of Philip Morris cites a 1991 bilateral treaty between Switzerland and Uruguay. Since filing the complaint in 2010, the tobacco company has also closed its only cigarette factory in Uruguay.

The regulations ?are extreme, have not been proven to be effective, have seriously harmed the company?s investments in Uruguay,? according to a statement by Philip Morris International.

Uruguay, with a population of less than 3.5 million and an annual gross domestic product of about $50 billion, seems a poor match for the tobacco giant, which had sales of $77 billion in 2011.

Amid reports that government officials were seeking a face-saving settlement, Bloomberg Philanthropies announced in late 2010 that it would fund the legal defense of Uruguay?s anti-smoking laws. New York Mayor and businessman Michael R. Bloomberg, an ardent tobacco foe, affirmed the support of his namesake charity in a call to Uruguayan President Jose Mujica.

Advocates fear other countries may have a harder time standing their ground. ?Bloomberg has been very generous, but his resources are not unlimited and he can?t pay to defend every tobacco regulation in every country,? said Chris Bostic, deputy director for policy for the group Action on Smoking and Health.

The Uruguay case could be pivotal, said Dr. Eduardo Bianco, president of the Tobacco Epidemic Research Centre ?in Uruguay. ?If they (Philip Morris International) succeed with Uruguay they would send a clear message to the rest of the developing countries: ?take care about us, you can be next.?"

    Microsoft ads deride Google as bad place to shop

    SAN FRANCISCO (AP) ? Microsoft is trying to skewer Google as a lousy holiday shopping guide in its latest attempt to divert more traffic to its Bing search engine.

    The attack started Wednesday with a marketing campaign focused on a recent change in the way Google operates the part of its search engine devoted to shopping results. The revisions require merchants to pay Google to have their products listed in the shopping section.

    In its new ads, Microsoft Corp. contends the new approach betrays Google Inc.'s longstanding commitment to provide the most trustworthy results on the Web, even if it means foregoing revenue. To punctuate its point, Microsoft is warning consumers that they risk getting "scroogled" if they rely on Google's shopping search service.

    The message will be highlighted in TV commercials scheduled to run on NBC and CNN and newspaper ads in The New York Times, The Wall Street Journal and The Washington Post. The blitz also will appear on billboards and online, anchored by a new website, Scroogled.com.

    The barbs are injecting more antagonism into an already bitter rivalry between two of the world's best-known and most powerful technology companies.

    Google's search engine is dominant on the Internet, and Bing runs a distant second. Microsoft's Office and Windows software remains an integral part of personal computers, but Google has been reducing the importance of those programs and PCs with the success of Web-based services and its Android operating system for smartphones and tablet computers.

    Google doesn't require websites to pay to be listed in its main database, the index that provides results for requests entered into its all-purpose search box. A query made there for a particular product, such as a computer, will still include results from merchants who haven't paid for the privilege of being included.

    But that's not the case for someone who clicks on a tab to enter Google's shopping-only section, which is designed to compare prices and offer other insights such as identifying sites that offer free shipping. Searches there are confined to paying merchants. That means results from sites, including Web retailing giant Amazon.com Inc., aren't displayed unless they pay. Amazon has only occasionally paid to have some of its wares listed in Google's shopping section. Zappos, a site owned by Amazon, has been more willing to pay the price to be listed in Google's shopping results.

    Google defends the fee-based approach as a way to encourage merchants to provide more comprehensive and accurate information about what they're selling.

    "I think you just get a well-organized set of product information, ways to buy it, and really have a great experience there," CEO Larry Page said during a conference call with analysts last month.

    In a statement, Google said it's pleased with the response to the new shopping system, which offers listings from some 100,000 sellers.

    Google, like Microsoft, also accepts payments for ads that are triggered by specific search terms and appear to the right or on top of regular search results. Those are labeled in colored letters as ads. The same distinctions aren't made in Google's shopping section.

    Since its inception in 1998, Google has tried to cast itself as a force for good while depicting Microsoft as a ruthless empire.

    But Google is less cuddly now that it's established itself as the Internet's main gateway ?and a well-oiled moneymaking machine. The Mountain View, Calif., company's search engine is so influential that government regulators in the U.S. and Europe are investigating whether Google has been stifling competition by giving special preference to its own services in search results.

    Microsoft, which faced its own antitrust inquiries more than a decade ago, is among the companies that prodded the investigation of Google. This time, it's pouncing on Google for straying for from its own principles.

    Google began limiting its shopping-only results to paying merchants in mid-October. The change coincides with what is expected to be the most lucrative holiday shopping season on the Web yet. The amount of money a merchant pays is one factor that influences the order of the shopping results, although Google says it still places the highest priority on each listing's relevancy to a user's request.

    Google discloses that it receives payments in small print at the bottom of the shopping results page. The notice is also visible if a user clicks on a link at the top of the shopping results page, under the heading: "Why these products?"

    What's left unsaid is the omission of sites such as Amazon, which tends to offer some of the best deals on the Web.

    The financially driven system for determining the results in a major part of Google's search engine breaks new ground for a company whose idealistic founders, Page and Sergey Brin, once railed against the perils of allowing money to influence which Web links to show.

    Brin and Page preached about the issue in academic papers that they wrote about search while conceiving Google as Stanford University graduate students. They also delved into the topic when they outlined Google's "don't be evil" creed in a letter written to potential investors before the company went public in 2004.

    "Our search results are the best we know how to produce," Brin and Page wrote in the letter. "They are unbiased and objective, and we do not accept payment for them."

    Microsoft contends that Google is doing a disservice to its users with the new approach, as many users may not even realize that the results in shopping search are being swayed by money.

    "We want consumers to know, in contrast to the route that Google has pursued, we are staying true to the DNA of what a good search engine is really about," said Mike Nichols, Bing's chief marketing officer. "We will rank results on what's relevant to you and not based on how much someone might pay us."

    Danny Sullivan, an Internet search expert who has been following Google since its inception, believes Microsoft is highlighting an important issue. "Google deserves to take its lumps on this," said Sullivan, who now works as editor of SearchEngineLand.com. "I have been surprised by how little attention this issue has gotten so far because it's a 180-degree turn for Google."

    Sullivan doesn't think Bing's shopping results are pristine, either. He points to Bing's partnership with Shopping.com, which also requires merchants to pay to be in its listings. Some of Shopping.com's data is fed into Bing's shopping section. When Shopping.com gets paid by a merchant for sale funneled through Bing, Microsoft gets a slice of the revenue.

    While all that is true, Bing's shopping section consists mostly of listings from merchants that haven't paid for the privilege, said Stefan Weitz, Bing's director.

    That's so, Weitz said, even though Bing isn't currently accepting listings from new merchants that want to appear in its shopping results. The only way a new seller can get into Bing's shopping search engine is to sign up for Shopping.com's fee-based service. After the holiday season, Bing's shopping-only section once again will accept free listings from new merchants, Weitz said.

    Like Google, Sullivan said Microsoft isn't doing a good job disclosing the role that money plays in its shopping-only results. He thinks that issue could undermine the effectiveness of Bing's anti-Google ads.

    Day of reckoning for Cameron and British press

    LONDON (Reuters) - Prime Minister David Cameron faces a no-win dilemma on Thursday when a far-reaching inquiry into British newspapers delivers its verdict on how to curb the excesses of the country's notoriously aggressive press.

    Cameron, who was embarrassed when toe-curling details of his cosy texts to one of media tycoon Rupert Murdoch's lieutenants emerged at the inquiry, will have to decide whether to accept its findings and anger a hostile press and many in his own party, or reject them and risk dividing his coalition government.

    He will also be conscious of the weight of expectation from a public that was scandalised to learn that journalists hacked the phones of victims of crime, wined, dined and paid police for leads and were in constant touch with senior politicians.

    Cameron will give his response to the House of Commons after the report is published at 1330 GMT, under scrutiny from high-profile figures such as Hollywood actor Hugh Grant who have campaigned for a clampdown on an industry they say ruins lives.

    The issue has divided the cabinet and could put the prime minister at odds with Nick Clegg, the leader of the junior Liberal Democrat partners in the coalition government.

    Following talks between the leaders on Thursday, a Liberal Democrat source said Clegg would deliver his own statement to parliament after Cameron, implying that the two disagree on the way forward. However the source played down suggestions of a major breach in the coalition.

    The inquiry was ordered by Cameron following public outrage at Murdoch's now defunct News of the World, a News Corp tabloid whose journalists hacked the phone messages of missing schoolgirl Milly Dowler, who was later found dead.

    Exposing the close ties between political leaders, police chiefs and press barons, the inquiry revealed the "dark arts" of journalists seeking ever more salacious stories in a bid to hold up dwindling circulation figures.

    Huge attention will be focused on whether Lord Justice Brian Leveson, one of Britain's top judges, recommends a new body to regulate the press with powers enshrined in law, or merely says the existing system of self-regulation should be overhauled.

    He could also criticise Cameron's government, including one of his most senior ministers, Jeremy Hunt, for close ties to Murdoch's News Corp and their handling of the company's aborted bid to take control of pay-TV group BSkyB in what would have been its largest acquisition.

    The press, backed by some 80 members of parliament, has lobbied hard for Cameron to resist calls for legislation, arguing it would curb freedom of speech and mean newspapers requiring state approval for the first time since 1695.

    "For today Britain stands at a crossroads," Murdoch's Sun tabloid said in its leader column. "In one direction: Official control of papers, with state sensors approving stories. In the other direction: A free press under stricter self-governance."

    UNACCEPTABLE PRACTICES

    However, a similar number of MPs, as well as academics and celebrities, favour statutory regulation, and opinion polls suggest the public agrees.

    A poll for the BBC said two thirds of people do not trust newspapers to tell the truth, while almost half want the industry to be regulated by a body backed by the courts.

    "The status quo is unacceptable and needs to change," Cameron told parliament on Wednesday. "This government set up Leveson because of unacceptable practices in parts of the media and because of a failed regulatory system."

    Some media have speculated that Cameron will give the press one last chance to get its house in order even if Leveson backs a new law.

    Under the watchful eye of Leveson, celebrities including Harry Potter author JK Rowling, singer Charlotte Church, Dowler's parents and other Britons who found themselves in the media spotlight, told the inquiry how they had been harassed, bullied, and traumatised by the press.

    Four prime ministers including Cameron were also quizzed in great detail about their links to newspaper owners, especially Murdoch, who himself endured two days of grilling, during which he denied playing puppet-master to those running the country.

    The inquiry heard intimate emails and text messages between Cameron and Murdoch's top lieutenant Rebekah Brooks, who goes on trial next year over the alleged phone hacking.

    ScienceDaily (Nov. 27, 2012) ? A collage shows nine radar images of near-Earth asteroid 2007 PA8 that were obtained between Oct. 31 and Nov. 13, 2012, with data collected by NASA's 230-foot-wide (70-meter) Deep Space Network antenna at Goldstone, Calif. On Nov. 5 at 8:42 a.m. PST (11:42 a.m. EST/16:42 UTC), the object came about 4 million miles (6.5 million kilometers) from Earth, or 17 times the distance between Earth and the moon.

    The images of 2007 PA8 reveal possible craters, boulders, an irregular, asymmetric shape, and very slow rotation. The asteroid measures approximately one mile wide (about 1.6 kilometers).

    Each panel shows one image per day, and all of them are oriented so rotation is counterclockwise. Each image is shown at the same scale and covers 1.1 miles (1.7 kilometers) from top to bottom. The resolution of the images varies from day to day as the asteroid's distance changed. The images achieve resolutions as fine as 12 feet (3.75 meters) per pixel on Nov. 5 and 6, when the asteroid was closest. The resolution was 25 feet (7.5 meters) per pixel on Nov. 2, 3 and 8, and 62 feet (18.75 meters) per pixel on Oct. 31 and Nov. 11 to 13.

    New radar measurements of 2007 PA8's distance and line-of-sight velocity refined calculations of its orbit about the sun, enabling reliable computation of the asteroid's motion for the next 632 years. 2007 PA8 is not a threat to Earth. The 2012 flyby was the closest since 1880. The next flyby with Earth closer than the one that occurred this year will be in 2488, when the asteroid will approach no closer than 3.6 million miles (5.8 million kilometers).

    NASA detects, tracks and characterizes asteroids and comets passing close to Earth using both ground- and space-based telescopes. The Near-Earth Object Observations Program, commonly called "Spaceguard," discovers these objects, characterizes a subset of them, and plots their orbits to determine if any could be potentially hazardous to our planet.

    JPL manages the Near-Earth Object Program Office for NASA's Science Mission Directorate in Washington. JPL is a division of the California Institute of Technology in Pasadena.

    From degeneration to regeneration: Advances in skeletal muscle engineering

    ScienceDaily (Nov. 26, 2012) ? A study published today in BioMed Central?s open access journal Skeletal Muscle reports of a new therapeutic technique to repair and rebuild muscle for sufferers of degenerative muscle disorders. The therapy brings together two existing techniques for muscle repair ? cell transplantation and tissue engineering ? specifically, mesoangioblast stem cells delivered via a hydrogel cell-carrier matrix.

    A number of conditions can lead to considerable degeneration or loss of skeletal muscle and, since skeletal muscle has a limited capacity for self repair, therapies for muscle reconstruction or regeneration are often necessary. There are currently two ways to rebuild muscle: cell transplantation, whereby stem cells are injected directly into the muscle or arteries, and tissue engineering, whereby cells are embedded on a biomaterial scaffold to reconstruct a whole muscle.

    Stem cell transplantation on its own can be limited by poor cell survival, but the authors hoped that the technique in combination with tissue engineering could increase the chances of efficacy for localized disorders of muscle.

    The research team, comprised of researchers from institutions all over Europe, embedded Mab cells within a polyethylene glycol and fibrinogen (PF) hydrogel scaffold that has a proven track record in tissue and cardiac engineering. The Mab/PF grafts were then injected into mice, directly into the chronically inflamed and sclerotic regions typical of the advanced stages of muscular dystrophy. The team observed increased engraftment and survival of Mabs when injected with PF than with Mabs suspended in saline solution.

    Five weeks after treatment, analyses revealed that Mabs had better integrated into regenerating muscle fibers when used with a PF carrier than when used without. In addition, there was better organization of muscle fibers when Mabs was used in combination with PF.

    Lead author Cesare Gargioli commented, ?This study demonstrates a novel tissue engineering approach that is capable of producing enriched donor cell engraftment into skeletal muscle after an acute injury or in more-difficult-to-treat advanced-stage muscular dystrophy. Both Mabs and PF are currently undergoing separate clinical trials, but their combined use may increase efficacy for sufferers with more localized forms of muscular dystrophy or disorders that lead to damage of skeletal muscle, including hernias and sphincter disorders.?

    BEIJING (AP) ? China is finding the once friendly ground of Southeast Asia bumpy going, with anger against Chinese claims to disputed islands, once reliable ally Myanmar flirting with democracy and renewed American attention to the region.

    Meanwhile, Barack Obama, buoyed by the first visit ever by a U.S. president to Myanmar, projected an image of a confident, friendly America, calling for a reduction in tensions and seemingly taking no sides.

    Beijing is struggling to find its feet as its own power grows, but the U.S. refuses to cede influence in the region, emboldening other countries not to fall in with the Chinese line.

    "The robust U.S. presence and relatively disciplined and quiet diplomacy looked strong relative to China's heavy-handed pressure," Ernest Bower, chair for Southeast Asian studies at the Council for Strategic and International Studies in Washington, D.C., wrote in a Thursday commentary.

    It's a reversal over the treatment Beijing enjoyed much of the past decade as it wooed Southeast Asia with soaring trade and investment and the lure of the huge Chinese market. Looking to further those links, Wen held discussions on expanding a free trade agreement to increase China's imports from Southeast Asia.

    China's economic "pull remains, but the smile has faded," said Aaron Friedberg, professor of politics and international affairs at Princeton University.

    Getting Southeast Asian diplomacy right matters to Beijing. It's an area where China historically exercised great sway. The 10 countries of the Association of Southeast Asian nations, or ASEAN, are home to a market of 600 million people and straddle vital shipping lanes and seas rich in fish, oil, gas and other minerals.

    Beijing's influence began foundering in 2010 when its more assertive claims to islands in the South China Sea touched off anxieties among the Philippines and Vietnam, who along with Brunei, Malaysia and Taiwan also claim the islands in whole or in part.

    Still, the friction has only increased. Beijing has become more aggressive in patrolling around the disputed islands, leading to a faceoff last summer with the Philippines over Scarborough Shoal. It is sparring farther afield over other islands with Japan, heightening worries about an expansionist China. It also started issuing new passports featuring a map that shows the entire South China Sea as Chinese territory.

    The tensions bubbled to the fore at an annual summit of Southeast Asian leaders in Cambodia's capital of Phnom Penh attended by Obama.

    Philippine President Benigno Aquino raised the Scarborough Shoal, prompting Chinese Premier Wen Jiabao to state that the islets have been "Chinese territory since ancient times and no sovereignty dispute exists." China's actions to assert its sovereignty were wholly "appropriate and necessary," Wen told the closed door meeting, according to Vice Foreign Minister Fu Ying.

    Egypt's Mursi faces judicial revolt over decree

    CAIRO (Reuters) - Egyptian President Mohamed Mursi faced a rebellion from judges who accused him on Saturday of expanding his powers at their expense, deepening a crisis that has triggered violence in the street and exposed the country's deep divisions.

    The Judges' Club, a body representing judges across Egypt, called for a strike during a meeting interrupted with chants demanding the "downfall of the regime" - the rallying cry in the uprising that toppled Hosni Mubarak last year.

    Mursi's political opponents and supporters, representing the divide between newly empowered Islamists and their critics, called for rival demonstrations on Tuesday over a decree that has triggered concern in the West.

    Issued late on Thursday, it marks an effort by Mursi to consolidate his influence after he successfully sidelined Mubarak-era generals in August. The decree defends from judicial review decisions taken by Mursi until a new parliament is elected in a vote expected early next year.

    It also shields the Islamist-dominated assembly writing Egypt's new constitution from a raft of legal challenges that have threatened the body with dissolution, and offers the same protection to the Islamist-controlled upper house of parliament.

    Egypt's highest judicial authority, the Supreme Judicial Council, said the decree was an "unprecedented attack" on the independence of the judiciary. The Judges' Club, meeting in Cairo, called on Mursi to rescind it.

    That demand was echoed by prominent opposition leader Mohamed ElBaradei. "There is no room for dialogue when a dictator imposes the most oppressive, abhorrent measures and then says 'let us split the difference'," he said.

    "I am waiting to see, I hope soon, a very strong statement of condemnation by the U.S., by Europe and by everybody who really cares about human dignity," he said in an interview with Reuters and the Associated Press.

    More than 300 people were injured on Friday as protests against the decree turned violent. There were attacks on at least three offices belonging to the Muslim Brotherhood, the movement that propelled Mursi to power.

    POLARISATION

    Liberal, leftist and socialist parties called a big protest for Tuesday to force Mursi to row back on a move they say has exposed the autocratic impulses of a man once jailed by Mubarak.

    In a sign of the polarization in the country, the Muslim Brotherhood called its own protests that day to support the president's decree.

    Mursi also assigned himself new authority to sack the prosecutor general, who was appointed during the Mubarak era, and appoint a new one. The dismissed prosecutor general, Abdel Maguid Mahmoud, was given a hero's welcome at the Judges' Club.

    In open defiance of Mursi, Ahmed al-Zind, head of the club, introduced Mahmoud by his old title.

    The Mursi administration has defended the decree on the grounds that it aims to speed up a protracted transition from Mubarak's rule to a new system of democratic government.

    Analysts say it reflects the Brotherhood's suspicion towards sections of a judiciary unreformed from Mubarak's days.

    "It aims to sideline Mursi's enemies in the judiciary and ultimately to impose and head off any legal challenges to the constitution," said Elijah Zarwan, a fellow with The European Council on Foreign Relations.

    "We are in a situation now where both sides are escalating and its getting harder and harder to see how either side can gracefully climb down."

    ADVISOR TO MURSI QUITS

    Following a day of violence in Cairo, Alexandria, Port Said and Suez, the smell of tear gas hung over the capital's Tahrir Square, the epicentre of the uprising that toppled Mubarak in 2011 and the stage for more protests on Friday.

    Youths clashed sporadically with police near the square, where activists camped out for a second day on Saturday, setting up makeshift barricades to keep out traffic.

    Al-Masry Al-Youm, one of Egypt's most widely read dailies, hailed Friday's protest as "The November 23 Intifada", invoking the Arabic word for uprising.

    But the ultra-orthodox Salafi Islamist groups that have been pushing for tighter application of Islamic law in the new constitution have rallied behind Mursi's decree.

    The Nour Party, one such group, stated its support for the Mursi decree. Al-Gama'a al-Islamiya, which carried arms against the state in the 1990s, said it would save the revolution from what it described as remnants of the Mubarak regime.

    Samir Morkos, a Christian assistant to Mursi, had told the president he wanted to resign, said Yasser Ali, Mursi's spokesman. Speaking to the London-based Asharq Al-Awsat newspaper, Morkos said: "I refuse to continue in the shadow of republican decisions that obstruct the democratic transition".

    Mursi's decree has been criticized by Western states that earlier this week were full of praise for his role in mediating an end to the eight-day war between Israel and Palestinians.

    "The decisions and declarations announced on November 22 raise concerns for many Egyptians and for the international community," State Department spokeswoman Victoria Nuland said.

    The European Union urged Mursi to respect the democratic process.
